1. Data controller

1.1 The data controller is Hôtel Le Passiflore, whose head office is located at LE PASSIFLORE, 2 AV D'ANGOULEME 16100 CHATEAUBERNARD (hereinafter “Hôtel Le Passiflore”). As such, Hôtel Le Passiflore – and/or its service providers acting in its name and on its behalf – determines the purposes and technical and legal means of processing personal data and undertakes to take all necessary organizational measures to guarantee secure processing that complies with the law of December 8, 1992 relating to the protection of privacy with regard to the processing of personal data (hereinafter, "the Law") and the European Regulation of April 26, 2016 relating to the protection of data of individuals with regard to the processing of personal data and the free movement of such data (hereinafter the “GDPR Regulation”).

1.2. Hôtel Le Passiflore is free to choose any natural or legal person who processes the personal data of users at their request and on their behalf (hereinafter “the subcontractor”). Where applicable, Hôtel Le Passiflore undertakes to select a subcontractor offering sufficient guarantees regarding the technical and organizational security measures for the processing of personal data.

2. Processing of personal data

2.1. Use of the Site, access to certain of its sections and/or any request for information or services from users of the Site may result in the communication of personal data. The processing of this data by the company Hôtel Le Passiflore, SASU PECHOT, (hereinafter referred to as “Hôtel Le Passiflore”), in its capacity as Data Controller, and/or by service providers acting in the name and on behalf of Hôtel Passionflower will comply with the GDPR Law and Regulation.

2.2. This Privacy Charter is intended to allow users to know, even before accessing the different sections of the Site and communicating their personal data, how Hôtel Le Passiflore processes users' personal data. The user must necessarily read it before communicating their personal data by completing the forms provided for this purpose in the different sections of the Site.

2.3 Personal data will be processed mainly in an automated manner, with procedures strictly linked to the purposes mentioned in point 3.

2.4. Hôtel Le Passiflore also collects certain personal data from users in order to recognize them and offer them an optimal, quality and personalized user experience. This collection also makes it possible to correct any errors on the Site. The information collected concerns the user's connection (IP address, geographical area, day and time of consultations, services consulted and/or used, etc.) as well as the device from which the connection takes place.

2.5. In addition to the personal data directly provided by users (first name, last name, postal address, email, etc.) when connecting to the Site, the computer systems and software procedures used for the operation of the Site indirectly collect certain personal data. the transmission of which is implicit in the use of communication protocols on the Internet. These data are processed for the sole purpose of carrying out anonymous statistical studies.

2.6. Any failure, partial or inaccurate information on personal data, marked with an asterisk, and therefore necessary for the execution of the requested service, makes it impossible. On the other hand, any failure, partial or inaccurate information on optional, unnecessary personal data does not result in any consequences.

3. Purposes of processing personal data

3.1. Depending on the different sections of the Site, the purposes of processing personal data will be as follows:

a) authorize the user to register on the Site, as any authorization is necessary for access to certain specific sections of the Site as well as for the use and interaction with the various services offered;
b) after prior consent of the user and until the revocation of this consent, carry out marketing activities (such as, by way of example only but not exhaustive, sending promotional and advertising material, carrying out related analyzes on registered users, which allow Hôtel Le Passiflore to improve the services and products offered to its customers); and this including by email, MMS and SMS, after special prior consent of the user and until its revocation;
c) managing the relationship between Hôtel Le Passiflore and users, for example by sending newsletters to offer the user information on all updates to the Site, offers, menus;
d) respond to user requests inherent to Hôtel Le Passiflore products, or to the Site (“Contact Us”, “Prices and Offers” section of the Site);

3.2. User registration on the Site is not required for the provision of certain services offered by Hôtel Le Passiflore (for example, the services previously mentioned in paragraphs c) and d)). However, in order to respond to any requests from users regarding these services, they will be asked to communicate certain personal data, which will be processed for purposes purely relating to the request and only for the period concerned.

5. Personal data likely to be processed

The following data is collected and processed:

7. Duration of retention of personal data

In accordance with the legal requirements imposed by the Law and the GDPR Regulation, Hôtel Le Passiflore only retains users' personal data for the time reasonably necessary to enable the accomplishment of the purposes for which they are processed.

8. Communication of users' personal data for internal purposes

8.1. Personal data may be transmitted to employees or collaborators of the Marketing department of Hôtel Le Passiflore who, operating under the direct authority of the latter, are appointed data controllers or subcontractors of this data and will receive appropriate operational instructions. Personal data may also be brought to the attention of employees or collaborators of those responsible if the latter, appointed by Hôtel Le Passiflore, so decide, provided that these data are processed in accordance with the purposes pursued.
8.2. Hôtel Le Passiflore ensures that subcontractors, employees or collaborators guarantee the same level of protection as itself and it ensures that these subcontractors, employees or collaborators, will process personal data for the sole purposes authorized by the purposes pursued, with the required discretion and security.

8.3. Personal data directly communicated by users by filling out online forms may be communicated and processed by the external service providers mentioned above acting in the name and on behalf of Hôtel Le Passiflore.

9. Recognized user rights

9.1. Hôtel Le Passiflore guarantees fair and lawful processing of users' personal data.

9.2. Hôtel Le Passiflore guarantees the user's right of access to their personal data.
In accordance with article 15 of the GDPR Regulation, the user has the right to obtain from Hôtel Le Passiflore the following (but non-exhaustive) information concerning his personal data:
a) the purposes of the processing;
(b) the categories of personal data concerned;
(c) the recipients or categories of recipients to whom the personal data have been or will be communicated, in particular recipients who are established in third countries or international organizations;
(d) where possible, the envisaged period of retention of the personal data or, where this is not possible, the criteria used to determine that period;
(e) the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4), and, at least in such cases, useful information regarding the underlying logic, as well as the significance and anticipated consequences of such processing for the data subject.


9.3. Hôtel Le Passiflore guarantees the user the right to rectify and erase personal data.
In accordance with Article 16 of the GDPR Regulation, incorrect or inaccurate data may be corrected or deleted at any time. It is up to the user to make the necessary modifications themselves from their user account initially, and then to ask Hôtel Le Passiflore to make these modifications if they cannot be carried out independently.
The user has the right to obtain the erasure of his personal data in the cases listed in article 17 of the GDPR Regulation.

9.4. Hôtel Le Passiflore guarantees the right to limit processing.
The user has the right to obtain the limitation of the processing of his personal data in the cases listed in article 18 of the GDPR Regulation.

9.5. Hôtel Le Passiflore guarantees the right to data portability.
In accordance with Article 20 of the GDPR Regulation, users have the right to receive from Hôtel Le Passiflore personal data concerning them in a structured, commonly used and machine-readable format. They also have the right to transmit this data to another data controller without Hôtel Le Passiflore obstructing this in the cases provided for by the GDPR Regulation.

9.6. Hôtel Le Passiflore guarantees the right to object to data processing
The user has the right at any time to object to the processing of their personal data when there are compelling and legitimate reasons relating to their particular situation. Hôtel Le Passiflore will no longer process personal data, unless there are legitimate and compelling grounds for the processing which override the interests and rights and freedoms of the user, or for the establishment, exercise or the defense of rights in court.

9.7. Hôtel Le Passiflore guarantees the right to lodge a complaint
The user has the right to lodge a complaint concerning the processing of his personal data by Hôtel Le Passiflore with the Commission for the Protection of Privacy.

10. Limitation of liability of the data controller

The Site may contain hypertext links to websites controlled and operated by third parties not linked to Hôtel Le Passiflore. Where applicable, Hôtel Le Passiflore cannot be held responsible for the content of these sites, nor for the personal data protection practices of these third parties.
Hôtel Le Passiflore cannot be held responsible for the loss, corruption of data or identity theft, which may be caused in particular, but not limited to, by the presence of viruses or computer attacks.
The Site does not contain information intended directly for minors. Minors must not disclose personal information or data to Hôtel Le Passiflore without parental consent. Consequently, Hôtel Le Passiflore invites all people exercising parental authority over minors to inform them about safe and responsible use of the internet.

Hôtel Le Passiflore reserves the right to modify this Privacy Charter in order to comply with the obligations provided for by legislation protecting privacy or in order to adapt it to its practices. The user is therefore invited to regularly consult the Privacy Charter in order to be aware of the modifications and adaptations.
